Jammie Thomas Trial 2.0 Ends with Even Bigger Damages
Posted 06/20/2009 at 12:34:55am
Honestly, I hope the RIAA sues me. Really, I do. There are a few ways to win this case.
1. How do they know the people who downloaded the songs didn't own them? The judge already asserted that just making the songs available for illegal download wasn't a crime, it was only a punishable offense if someone actually downloaded the songs illegally. Downloading an mp3 of a song you own is routinely seen as 'fair use' and not illegal. If the downloads can not be proven to be illegal, Jammie can not be found guilty.
2. How do they know it was me? This is a weak defence, but still adds a little layer of doubt. For all the RIAA knows, the uploadeder was some neighbour who accessed her open wireless network.
3. The previously mentioned 'the music isn't whole' defense. The prior comment explains it better than I can.

that was just an attempt to see how much hardware I could stuff into a sub $500 build. I still have $34 to play with so if you use the case/PSU mentioned in the article and drop down to an x2 Black or something, you'll still be under $500.

After having listened to the podcast a couple more times, I find myself enjoying it! Well done, very well done indeed. But please, if you NEED to sing, make sure that Nathan isn't the one doing it.

Although I have only listened to the podcast for the past year or so I have also noticed a steep decline. After the first podcast I was hooked, I loved the entire thing (read: Gordon's Rant) but now listening to some of the newer releases seems like a chore.
The one thing I did really like about this podcast was how honest they were about they amount of terrible in their 100th episode 'spectacular'. And I do still greatly appreciate the (sometimes) weekly podcast.

Instead of this being episode 100 of the No-BS podcast, they axed the old model and made episode 1 of the All-BS podcast!
