College Student Hauled Off for Hacking Game Consoles
Posted 08/05/2009 at 01:06:35pm
The issues is that he sold his services to hack the box. You purchase the item from manufacture you can mod you heart away as long as it is for your own use and your not using it to break any laws. In this case he was selling his services which allowed others to break the laws and making a profit in circumventing someones else intellectual property. But lets be honest he probably broke some of those laws himself otherwise why hack it. Odds are those import games mentioned below were not ligit copies that some of you mentioned wanting to play. There is a reason that game cost $5 in china as opposed to the $50 here.
RIAA Declares DRM is Dead, Has Hell Frozen Over?

The Digital Millennium Copyright Act (DMCA) is a US copyright law that implements two 1996 treaties of the WIPO. It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures (commonly known as DRM) that control access to copyrighted works. It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. In addition, the DMCA heightens the penalties for copyright infringement on the internet.

The cases hinge on DMC not DRM. Lack of DRM does nothing to diminish DMC.

Microsoft Obtains Patent for PC Ransom

I believe the only law suits that will stick in court are the ones that result in inadvertently shuts down of a legal install. I suspect there will be a mass of law suits from the guilty in hopes that MS would rather avoid a PR mess. But the simple fact is if you’re using a pirated version then MS has every right to disable their product, their OS not the computer. After all you’re free to use another OS. If they lock you out of your MS OS or keep you from upgrading drivers, oh well, pay the fee or go to court and try to prove your install was legal. They are in no way disabling your computer just their OS. MS is simply preventing you from using your pirated version that you failed to license from them. How you use the computer is your decision, so choose wisely. A business knowingly using a pirated version has to face the consequences or play legally. Home users should be aware of what could happen to their treasured files if they elect to go pirate the software.
