A reasonable patent holder shouldn't have to decide if his patents are enforceable or not. The patent never should have been issued in the first place. So they are immune to a Sherman action, but they will obviously (or rather, hopefully) not get any money for their stupid claim. It's a list!

Just watched that "Zero Punctuation" review! LOL!!! In the bad ending you end up as a cross between Hitler and Skeletor "whose very piss is pure liquid malevolence"!!!! Wow.

Deus Ex is still my favorite game of all time. Max Payne is usually number 2 or 3. BioShock is a great game no doubt, and maybe even on par with Half-Life 2. (I personally put it with FEAR--by no means an insult as FEAR rocked). But you're right Dave, that doesn't mean its innovative. It's just a great execution of common FPS elements and great visuals. But the story is nothing compared to the depth and scale of Deus Ex or Max Payne.

Sorry, you are completely wrong. The 8800 GTX lacks PureVideo HD because it was the first out. When they rolled out the 8600 line, they had time to implement it. Anandtech says the R600 might be able to do HD through a firmware update, whereas the 8800 GTX lacks the silicon to do so. Your whole theory ignores the mainstream gamer sector who can't afford an 8800. (Although I agree there is no real reason to buy anything less than a 8800GTS 320, except for HTPC) There will always be a need for budget GPUs. Where else would HP/Dell/etc get their cards from?

I think it is a generally accepted principle of open source that users should be free to modify software. However, Tivo should be able to stipulate in their service contract that users should not modify the box. As long as people still have to pay monthly for the Tivo service, I don't see why Tivo cares if they mod the software to enable more hard drives or whatever.

Facebook was wrong to let in high school kids, and it is now dead because of the developer applets. That essay you linked to didn't seem to be a very empirical study, at least not upon cursory examination. Personal experience seems to validate her points though.
