If memory serves me correctly, originally Google was asked to join their group and refused. And then they messed around on their bidding employing some kind of funky formula that jacked the bidding price up.

This looks like payback from the Rockstar group. Regardless, I wish I'd stop hearing about all these stupid lawsuits. They've got to stop.

So Google buys Blackberry. Problem solved. They don't even need to buy all of BlackBerry. 51% and they can grant themselves access to the patents they are infringing on.

According to my volatile memory from last spring when I took economics class, I believe it would be illegal for google to do so. Otherwise they will be violating the Antitrust laws and Regulations set by one or all of the following:

- Sherman Act of 1890
- Clayton Act of 1914
- The Wheeler-Lea Act of 1938
- Celler-Kefauver Act of 1950

(I don't remember which Act exactly that pinpoints to this, but here they are anyways)

Basically, to prevent illegal monopoly and prices not set by the equilibrium of demand's and supply's curves, the feds made it illegal to own large sum of shares of a competing company (in monopoly market).

Just a thought.

For a full takeover Google would need government approval. At this point there are enough phone companies in the world I don't think it would be stopped. However what Google needs isn't a phone company. It's the patents. So the strategy is to buy controlling interest. Use that to force the access to the patents. Then sell.

HTC and BlackBerry have market capitalizations of about 4 Billion.

I'm not privy to the patents Google got with Motorola though. They may be sitting on fundamental patents that will bleed out the Rockstar team and haven't been using them. Google hasn't been nearly as aggressive as MS and Apple. Either they have no game or they were waiting for the other shoe to drop (which it just did).

We shall see.

That would require a leveraged buy out, the shareholders would have to vote...

I used to own Sun and Gateway. Sun had good prospects. Gateway was profitable. Oracle and Acer bought them. I voted no. I lost. Sun was having problem but owned some excellent business assets. I could see the problems maybe tipping the vote. Gateway though was making profit, winning editors choice awards again and otherwise starting to do well. Still, I thought I'd end up losing the stock so I asked them to issue my certificates so I could hang them on the wall after the company died. The shares would be worthless after the takeover. They would normally do this. But before the deal was approved by voters they had already shut down normal stock holder dealings and refused. I didn't realize it yet but this told me that the CEO of gateway was worthless. No doubt this takeover best served his interests and the shareholders voted for the takeover.

Shareholders are stupid. CEOs and Boards fleece them like sheep regularly.

I would normally agree, however, in this case the only reason for googles controlling shares would be to divest the patent portfolio.

I would hope the shareholders arent that stupid.

But, you are probably right, they wouldn't care.

I'm not sure which side I'm taking with this, the only patent troll on the left side is Apple. We can't possibly have any legitimate opinion until we know a lot more.

Reality is both infringe. There are too many patents in the wild covering to many things and which are too fuzy for any Smartphone and OS maker to not infringe on others.

The only reason Microsoft and Apple get along is because they signed a deal a long time ago to not copy the big stuff and they would overlook the small stuff.

That's the path to long term success. I'll side with the first company that proposes it.

That's a laugh appleroxin, android has a way bigger market share than apple, there not going anywhere. If you can't beat them try suing them, should be apple's motto.

Sony, as an owner in Rockstar is protected against the lawsuit. They have the benefit of access to the patent.

Sort of, the Android platform itself may be found infringing against X patent(s) held by the Rockstar group.

However, as a member OF the Rockstar group, SONY can then absolve themselves of any damages to themselves via their own business since they are on both sides of the equation.

It would be akin to suing yourself for not paying yourself back money you borrowed from a coin jar you'd been saving... To even litigate such a matter would be beyond preposterous, and enforcement of any theoretical ruling would be asinine.

Yeah, I'd have to call bullshit too...and I like/don't hate Apple. Android's not going anywhere even if they have to change a few things here and there in the event that they are "found to be infringing."
