 Post subject: Vaporware worthy of a suit?

Well, that's basically the topic. Is there grounds for a class action lawsuit for vaporware?

That's pretty general I know. So, more directly, are there grounds for action against the lack of PCIe cards even though they're being advertised on sites for such a long period of time?

I'd like to strike out on nVidia, but the one that really stands out is the ATI x800XT-PE (and even more directly, the PCIe version). They've been on both Abit and Asus sites since August, yet I have yet to see one in the wild. I've actually ordered the Asus version and they charged my account at one time, but then was soon refunded with a $15 "we're sorry" gift to make me feel happy all over. Didn't work.

So, back on-topic. Is there something we enthusiasts can do to fire back at this onslaught of Vaporware that's plagued us for so long? Can they actually keep making promises and not supply the product without recourse? I know I'd get sued...

You can probably file a suite, but finding a lawyer willing to represent you and being able to prove an economic loss. I don't think you will find a court willing to rule on your side because of an "I want this now" case.

Go to the BBB and you can complain in the way of false advertising claims or something like it, you would probably get one pretty quickly.
