Judge Edward R. Korman just violated the 4th Amendment to the constitution of The United States that this Judge swore to uphold, therefore he should be at least removed and Impeached ! But I would like to see this liberal twit arrested ! DAMN, we *still* have a constitution and I'm sick and tired of liberals destroying it !!!

But they taught me that the constitution was a) spelled with a lower case c & b) a "living document" to be "adapted" to fit the times because the Founding Fathers were clearly too dumb to predict 21st century life from the 18th century...and those who didn't buy into that are the minority.

The solution is simply to refuse to hand it over or say F-CK you and smash it if they try taking it by saying IF I cant have it NOBODY is.... I've smashed 4 devices ( iPhone 4, iPad2, HTC smartphone, Galaxy S3 smartphone) now to keep the Feds and pigs from stealing my stuff before because confiscation is basically theft by the F'N Feds or F'N pigs PROVE ME WRONG!!! How long you think I stayed in jail for smashing my own property? Less then an hour!!!!! Oh and all my stuff had extended warranties so they were all replaced for FREE!!! Throw a smartphone on the floor with all your strength and I guarendamntee you its busted beyond the Feds ability to repair it especially since the devices I smashed were all encrypted.

I would not even attempt to reclaim my stuff and just deduct the amount from my income tax; and get a nice upgrade. Make the pukes come after you in court and see who the jury sides with. The problem with smashing is I don’t think you would destroy the data whether it be an SSD on a PC or NAND chips on a mobile device, it would take a lot to get them truly unreadable. Encryption is the way to go with PCs. For mobile devices with all the back doors, I don’t know if there is a good option to prevent the theft of your data by the Feds unless you are nerdy enough to load your own android that you built. Perhaps you can try smashing the devices but there is a good chance the NAND chips are still readable and that makes claiming it as a loss for taxes really tough. What can you do to stop the fed from stealing your data on mobile devices? I guess if the border agent is just screwing with you they would not bother to read the chips of a smashed phone, but you can’t be sure.

These judges sicken me. They're making a mockery of justice and the Constitution. They're the biggest part of the problem. If the judges simply did their jobs and held legislators and law enforcement accountable it would never have gotten as bad as it is. I think most of the blame for what is wrong in America today rests on the shoulders of judges like this guy. There should be serious consequences for judges who do this kind of stuff. The public should be able to vote them out and seize their property, possessions, and that of anyone who may have inherited anything or benefited from them financially. I imagine that would create enough fear of the public to keep them more honest.

I'm stridently against this in principle. DHS is another one of the many government programs that was an idiotic idea when it was first implemented but has since grown into an uncontrollable monster.

...when Rick Perry bumbled the third agency, he should have just gone with "DHS" or its evil, Joffrey "Baratheon"-like child: the TSA.

I don't recall the constitution being about "substantial risk" instead of "YOU WILL GET A WARRANT". I also don't recall it being about where citizens were so much as applies to them regardless.

Edit: But I'm not a judge so my job is to just adapt.

We just pissed off the Indians by strip searching one of their diplomats and our Administration doesn't care. Since they don't care that they just pissed off one of our allies and a powerful one at that (and deprived themselves of Tech Support) I'd bet that they don't care about Joe Public suing them.

So the good guys get @#$%ed again and the bad guys just have to find a better method, such as the internet and it's various forms, so that when they do confiscate it, they basically have a blank, basic computer item with little more on it then a browser. Heck, they can even have a panic button that wipes out any other items with a 0-1-0 or 1-0-1 protocol to make them very unreadable/retrievable permanently.

This solves nothing other then taking away yet more rights.
