Pump Up the Volume, APPLE WINS HEARING LOSS CASE!
Go ahead an crank up the volume on your iPod touch, just don't go crying to the courts if you rupture an eardrum in the process. That's because a San Francisco federal appeals court on Wednesday upheld a 2008 district court ruling saying Apple iPod earphones can't be held responsible for hearing loss.
"The plaintiffs do not allege the iPods failed to do anything they were designed to do nor do they allege that they, or any others, have suffered or are substantially certain to suffer inevitable hearing loss or other injury from iPod use. At most, the plaintiffs plead a potential risk of hearing loss not to themselves, but to other unidentified iPod users," Senior Judge David Thompson wrote.
The plaintiffs, Joseph Birdsong and Bruce Waggoner, had sought monetary damages, and also asked the court to require that Apple provide better earphones, test iPod users for hearing loss, and offer disclosures.

Not likely, they'll just keep appealing it until some dumbass bleeding heart liberal judge gets hold of the case and actually judges in their idiot favor.

The iPhone OS also has a feature which allows for a volume cap that can be locked. I'm not sure if this can be adjusted for other iPods through iTunes but it certainly is a nice feature on the iPhone/iPod. It's not like there aren't any volume settings/buttons on these devices otherwise. Even the new shuffle doesn't have built in buttons but the ear-buds that come with it do control the volume. Oh well. As long as idiots roam the world, we can always be sure to find new and amazingly frivolous lawsuits.

Reminds me of the Futurama episode "Spanish Fry."
Bigfoot ... Endangered
Mystery!In the dense forests
of the Pacific Northwest dwells the strange and beautiful creature known as Bigfoot,
perhaps.
Sadly, logging and human settlement today threaten what might possibly
be his habitat. Although if it's not, they don't. Bigfoot populations
require vast amounts of land to remain elusive in. They typically dwell just behind rocks but are also
sometimes playful, bounding into thick fogs and out-of-focus areas.
Remember, it's up to us. Bigfoot is a crucial part of the ecosystem, if
he exists. So let's all help keep Bigfoot possibly alive for future
generations to enjoy unless he doesn't exist. The end!

That would like sueing a car manufacturer like Dodge, or Toyota because you got in a wreck. If you blast the iPod at full volume or louder than normal what do you expect to happen? Better hearing? lol what a tard.

I'd say more like sueing them for allowing you to speed and getting in a wreck Just because it can does not mean you should.
