Pirate Bay Defendants Denied a Retrial
Posted 06/26/09 at 09:32:18 AM by Paul Lilly
After ruling that the judge overseeing The Pirate Bay trial earlier this year was not biased despite his affiliation with various copyright organizations, a Swedish court voted unanimously to deny the defendants a retrial. They will now have to hope for an appeal.
"The Court of Appeal has come to the conclusion that none of the circumstances set out, individually or taken together, means that there are legitimate doubts about the judge's impartiality in this case. There has not been any bias," the court stated.
Each of the four defendants in The Pirate Bay trial were found guilty of assisting copyright infringement and sentenced to one year in prison along with $3.6 million in fines to be split among the founders. But the verdict and sentence weren't without controversy, as it was later learned that Judge Thomas Norström is a member of the same copyright protection organizations as some of the main entertainment industry representatives.
"The Pirate Bay will now file charges against Sweden for violation for Human Rights. More info later. (The bias-judge is himself biased...)," Peter Sunde posted on his Twitter account.

Some people will never get it...

In order for the defendants to get a retrial they have to demonstrate how their conviction does not square with the facts of the case. The judge's bias is irrelevant if his decision was based firmly on the facts and how they relate to the law. The appeals court agreed with the lower court.
What a pathetic joke those parasites are: “The Pirate Bay will now file charges against Sweden for violation for [sic] Human Rights.”
Score one for the copyright owners.
The Pirate Bay hosted thousands of links to copyrighted material for the expressed purpose of bringing users together for copyright infringement. That’s a textbook example of aiding and abetting. It’s a slam-dunk conviction. Grow up and deal with it.
Thank goodness for truth and justice.

There are plenty of places to get freeware and shareware.
The only reason The Pirate Bay exists is to facillitate theft.
It really is that simple. Hopefully, the trend of charging end users will continue on an international level and those who believe it's OK to steal get prosecuted.
Everyone in the Pirate Bay organization should be locked away for many years as well as others like them.
Nobody believes it's wrong to prosecute someone who steals their wallet or car and theft of software is no different.
If you believe it's alright to steal software then yoiu are a criminal and should face fines and jail time!
Just because you've decided to justify it doesn't make it right.
Thankfully, common sense and justice has prevailed in this case.
Yep..

Just like gun makers are there to facilitate murders, screwdriver makers to facilitate car theft, computers facilitate identity theft, and money facilitates bank robbery...
Its not Pirate Bay's fault..blame the uploaders and downloaders. If every torrent was legal, would Pirate Bay still be at fault? Also the RIAA and MPAA are just pissed because Pirate Bay won't succumb to their nazi-like tactics and police their own site.

Yes, it should be the uploaders/downloaders fault for downloading illegal material through TPB, not TPB itself. The fact of the matter is that TPB officially states that they will not police their own site, so how can these individuals be accountable for the actions of others? Even if TPB gets taken down, then another one will simply take its place. The only way to ensure that piracy reduces is to stop strangling individuals with very-restrictive copyright laws/acts and to find ways to "reward" their customers, rather than punish them with DRM restrictions, etc.
and that's....completly

and that's....completly irrelevent to this case.
FACT: The judge was part of the board of the Persecuting party
FACT: He was not idited for bias
FACT: Judges are EXPECTED and HELD to law to be UNBIASED

I'm not pro-copy protection or pro-piracy, but that judge better not do any more anti-piracy cases, just in case.
