Microsoft Uses The Apple Legal Defense in Xbox Anti-Trust Trial
Microsoft isn't usually the type of company that likes to compare itself with Apple, but in its anti-trust case over the Xbox 360, they are borrowing a page from Steve Jobs legal manual to justify the walled garden that is "Xbox Live". According to Microsoft, if Apple can prevent Psystar from selling unauthorized hardware with OSX, why shouldn't they be able to stop unauthorized accessories from being sold on the Xbox 360?
The company at the heart of the lawsuit is hoping to sell a game genie type device to allow in-game cheating, but if aftermarket accessories were to become a real possibility, I'm sure they wouldn't be the only ones to hop on the bandwagon. I know at least a few PC Gamers who have taken issue with SSD style prices for 5400 RPM laptop upgrade drives simply because they have no other choice.
Datel argues that Microsoft is monopolizing the market for "Multiplayer Online Dedicated Gaming Systems". This won't be an easy thing to prove, but do you think Microsoft is up to its old monopolistic tricks again?

Because Apple doesn't prevent anyone from selling unauthorized accessories.
Now if DELL were selling copies of Windows 7 (without the hardware) at OEM prices and paying Microsoft as if they were selling preinstalled versions, then Microsoft would have a point.

Now you can't prevent 3rd parties from producing and selling normal accessories for the sake of making money (hence monopolizing), but Microsoft (and any other company or group) has every right to protect their services. I don't want to go mono a mono agianst some unmanlly modder as I play my games online. 3rd parties can make their storage devices, and controllers, just don't go making accessories that causes problems for others (like Game Sharks and stuff).
I would like to see Microsoft make aware of some sort of anti cheat system like Sony did with their DNAS.

One thing I think many are missing here is it's not that this device is just some kind of cheating device. No it's a device that cheats the established system that Microsoft has in place. In that regard it's wrong, however I think Microsoft has a right and obligation to protect it's customers. Personally I would think it would be the beginning of the end if they allowed these things to used on line. Many of us remember the days before Punkbuster, and it wasn't pretty, or fun.

Unless something's change, you'll need a specific Western Digital drive to do that, and it only goes up to 120GB last I checked.
I know you weren't being serious, just had to point out the drive limitation!

you do realize they made a 250gb hdd for the modern warfare 2 limited edition console right? ie then there is a bin for a 250gb hdd, ie a end user could use a 250gb WD BEV to make an xbox 250gb hdd /end

Do I really wanna go up against a kid with a Modded anything on Xbox live? Shit half of the game players on COD MW2 are under the age of 17 and have nothing to do but play all day. I can barely beat those kids, but to add onto this that fact that they are modding I will never win. I work so Xbox is not my life but a hobby. Don't take it away from me because some 13yr old asked his mom for a modded controller and a modd chip to advance him thru the rankings to obtain all the guns and gadgets mean while i only play 3 hours a day and it takes me 45 days to do. Give the kid a Modded lawnmower send him out to mow the grass!

i hate this new wave of lawsuits that the big guys (microsoft, apple) are throwing at the little guys (psystar, Datel). it is freakin stupid to think that people will keep buying technology if they can't do anything with it. It's like buying a Soccer ball, but the box says it can only be used on a certain field. it's beyond me why EULAs even still are in effect.
And microsoft is wrong. If Datel isn't doing anything illegal as far as something like selling memory units with pirated games or something on them, i dont see why microsoft would win.
Nobody makes anybody do anything, except laws and taxes and stuff, but Monopolization is the act of one company trying to completely own one sector of an economy and everything about it. If a person wants to upgrade their xbox's hard drive, they have to buy a microsoft drive. there is no workaround (to my knowledge), and if a manufacturer other than microsoft tries to make a drive, microsoft updates the firmware to disallow it. Apple does the same thing, and i honestly hope that this goes to a court that understands technology and fines microsoft heavily. not some 20 million dollar fine, that's nothing to them. same with apple.

Yes the drives are way over priced, but you can always do what I do, use the xbox drive for just that the xbox. I have all my music and movies stored on an external drive and use that with the xbox to access my media. Works great!!! Ya its a crappy solution, but it's the only option we have right now.

Sure, but I think most people are thinking about the actual games being installed on the drive. I know that I can't play the 360 off the DVD drive, the sound is INSANE. Therefore, I resort to the 120GB HDD for installation. I don't think you can install games on an external drive...correct me if I'm wrong.

The Game Genie was a great product back in the day of Nintendo. I wouldn't mind getting one for todays systems. Nothing sucks worse than have a $60 game that you get stuck on a level you just can not get past. You would like to continue the game and know the story out come, so pop in the genie and go into god mode. Heck the 360 and ps3 are the first systems that don't seem to have a game genie, or even much with cheat codes. I don't want people cheating in online play but at home with single player why not.

I agree completely with that! As for the PS3 and 360 being the only systems, last I checked the GCN version of Action Replay didn't work on the Wii (and the apparent Wii version stopped working too) because Nintendo updated the firmware to block/dissallow those apps...

A $1500 gaming rig doesn't get sold at a loss. This is typical for game consoles. Software and accessories are liscensed by the console designers. Note that I said designers, not makers.

Datel is wrong. If you go by sales figures, Nintendo is monopolizing the market for "Multiplayer Online Dedicated Gaming Systems" (also known as "consoles"). I think Datel's plan was to make Microsoft settle the case, unless they have to endure enough legalese that their heads explode.

ok this is how i see it/ WII you get to buy any sd card. PS3 you can use anythig for save data. xbox its 60 bucks for a 512mb card. its 100 bucks for a 60gb hdd. i could spend the same and but a 750gb 7200rpm drive in my ps3. In other worlds i'm tired of mircosoft monopolizing this shit. O think datel should compromise and make a memory card without expandability so MS can't bitch about cheating.

But is the experience across the consoles the same? No. Are there exclusive titles you might want? Yes. And from the way the poster mentioned the PS3, he seems to own both consoles. What if one prefers the XBox Live system over PSN?
But aside from all that... are you defending the ludicrously priced laptop hard drives for the 360?! It's seriously ridiculous.

What really sucks, is that you can't upgrade the 360's HDD past 120GB as the drive you need to buy, I think only goes up to 120GB. I think Microsoft should allow gamers to install larger HDD's. Maybe if they sold an 'upgrade kit' which comes with the tool to open the HDD and a CD to initalize your new Drive... Just a thought!
Thats the one thing I like about the PS3 is that I can install as large a notebook SATA drive as I want!

That's incorrect. They sell a bundle with a 250GB drive now. I don't know if there are plans to sell that drive separately in the future. But the fact remains that there is a 250GB drive out there. I think it's the MW2 bundle.
