Hosting Companies May Begin Flushing MegaUpload User Data on Thursday
The debate over the seizure of MegaUpload may intensify this week as the site's hosting companies, Carpathia Hosting Inc. and Cogent Communications Group Inc., get ready to purge its data, according to an AP report. Federal prosecutors said in a letter that the data purge could take place as soon as Thursday. With MegaUpload's money frozen by the government, customers who were using the service for legitimate purposes could be screwed.
Rothken is trying to prevent that from happening and claims to be working with prosecutors to keep data from being flushed down the Internet toilet, AP reports. According to Rothken, 50 million users have data stored with MegaUpload.
Federal authorities turned their attention to MegaUpload in full force following the SOPA/PIPA blackouts. Seven men were arrested and charged with various copyright crimes and money laundering, charges that have been denied by MegaUpload co-founder Kim Dotcom.
Following MegaUpload's seizure, Pirate Parties in several countries began putting together a list of affected users to prepare for a lawsuit against the FBI.
"The widespread damage caused by the sudden closure of Megaupload is unjustified and completely disproportionate to the aim intended,” the Pirates of Catalonia said in a statement.

I disagree with the link everyone's jumped on.
While I understand there's a timing "coincidence", this would have happened whether or not Sopa continued or not. The two have nothing to do with each other, except perhaps that they were waiting to see where Sopa headed. If it passed, they would have siezed under that name. Since it's been withdrawn, they just siezed anyway.
To think that they are being "vengeful" or did this in response to SOPA is silly.
AFA legit people losing files...read the user agreement on these sites people. They are not responsible for loss of information, and neither is anyone else. If you're looking for someone to blame, blame yourselves.
Rule #1: always backup your files.
Finally, all that aside, megaupload was a horrible site to use and I really don't care if it's gone. When you go to a page and feel like you're being "tricked" or "manipulated" eight ways to Sunday into clicking the wrong button (that leads to some advertiser or something), it's not a site I want to deal with. I don't know why anyone ever did.

Right and you knew this was going to happen at this time before you even heard of SOPA right? SO you can say this for sure. Oh you cant? Your full of shit buddy. Hell, maybe Obamas attempts to demonize the 2nd Amnd dont coincide with Fast and Furious either eh? No, the fact that he was using Mexico as a reason to get rid of guns altogether has NOTHING to do it huh.
Your a lamb of a sheep. Wake the fuck up. This is how your criminal government operates. And dont be so stupid as to think that this has anything to do with you, backing up your files or how good or bad MU was as a site.

1)yes, there have been seizures and take-downs of sites prior to SOPA's announcement in the name of copyright violation. No, I did not know it was going to happen to this particular site, as I (as stated) used that site as absolutely little as possible, and knew nothing of how it was used on a non-legit basis.
2)I will keep my govt views to myself, but Obama was opposed to SOPA as it stood. Your argument makes no sense.
3)MaxPC is for tech news. We talk tech here. If you're looking to start a political movement, go somewhere else.
4)You don't know me. Your personal insults are unwarranted, un-called for,out of line, and meaningless to me. I do not hear them.

The FBI does not need to prove that ALL the data at Megupload was pirated
YOU "Legitimate Users" however DO need to research the Logic behind your claim that the FBI is responsible for your decision to do your banking with a Crak dealer, hiring babysitting services from a sex criminal and uploading "Legitimate files" to a service designed to steal "Legitimate Files"
Just do some research before doing business with a crime syndicate!
It's easy to find out if they are dealing in stolen software and media before you send them "Your" software and media
Just go to Google and typeWindows 7 Megaupload
Photoshop Megaupload
Premier Megaupload
Windows XP Megaupload
etc
etc
etc
etcJust Type your favorite expensive software title and add the word Megaupload to find the hundreds or thousands of stolen copies of EACH title at Megaupload totalling MILLIONS of illegal software and media titles
Now just go back and do the same thing for RAPIDSHARE!
Hmmmmm,
You HAVE been Warned!
Don't cry about Rapidshare when it goes bye-bye
YOU HAVE NO CLAIM!
However, if wealthy "LEGIT" users feel that their data is irreplaceable, simply raise the funds to protect that data in the Mega-servers while there is still time
No?
then go cry to mommy
nobody wants to hear you whine about how the Evil Feds took all your money from your Crak dealer Banker or your Legit Files from a company that refused to get accredited by the Better Business Bureau and that you could EASILY have researched on your own!

Big deal. I could upload a cracked Windows7 ISO to my FTP on GoDaddy(changing soon!) just like any idiot did on MU. Whats the difference? And why is the hosting site the one getting the blame and not the ppl who ULed or DLed the files?

Please understand the difference between copyright and trademark.
QUICK LESSON:
Copyright protects the contents IN ITS MEDIUM.
Trademark protects words, phrases, colors, and related content from being used by your competition for business purposes.THUS:
Since he's not using that name in the medium in which it was copyrighted, it's not infringing. Now, go to school.

This is just disgusting. It was clearly a desperation move from the FBI after SOPA failed. If things like this keep happening maybe I will just stop paying taxes and supporting this evil controlling government. Its ridiculous that they cant even give people their files back. How long is it gonna be until they start breaking into peoples computers under suspicion of so called piracy? I guess since they dont need warrants anymore just suspicions they can just do whatever they want. Whatever happened to the constitution FBI? You get to just break the rules as you want? They at least owe those people who were using the site for legit purposes. Thats the least they can do.

If you think there is something constitutionally wrong with all this, why don't you take it up with the FBI instead of just venting about the matter?

Theres really no Constitutional grounds for the FBI to exist in the first place.
It was kind of a big a deal when it was first introduced, it was also kind of a backroom deal. Same with all these other crock pot alphabet soup organizations. The TSA does nothing to really keep us safe but now that their there good god the country would descend into anarchy if we got rid of them!
This country has gone so far off the rails of the founding documents i just shake my in anger and my head in shame when i hear people puzzled about why we are so fucked right now. Heres a little hint, it has nothing to do with the health care system or public schools. Everyone is scrambling to blame our problems on everything ACCEPT what really matters. Its a blatant attempt to keep people distracted and stupid.

Please read the powers granted to the executive branch in the Constitution. It's might not be directly stated but the power of the President to enforce laws is broad enough to grant him/her the right to create organization to enforce the laws passed by the Congress.

Such is the nature of "cloud computing". But don't worry. The servers all promise your data is "safe". And it will always* be available to you. *(until it isn't)

If you're aim is to protect the freedom to share on the internet, it probably doesn't help to call yourself a "Pirate" Party, using the irrelevant word appropriated by the Media Companies to demonize your activity.

well if information was free like its ment to be they wouldnt be pirates any more now would they? Not that you cant make money with it, but the restrictions are fucking stupid and an obvious failure at this point. The only REAL way to restrict the flow of information is to cut people off from the internet. And thats what were seeing!
I see people acting according to the natural laws of data and information. Its the movie industry who made those people into pirates, not the other way around.

Hopefully Quinn Norton at MPC will jump on this with both feet to give us a greater in depth look at WTH is going on here. I find it difficult to believe that the government has the right to flush legitimate data or hold money from a foreign company unless it's terrorist related. Don't they need a subpoena or something to even take a look? If I ever stored anything anywhere in the Cloud, I'd be concerned about now. This is probably only the beginning. I mean, like - com'on!

They had a warrant, which is better than a subpoena. And they can order the destruction of such pirated material under the law..

Sure Modred, if it's pirated. So how does this apply to the legitimate stuff? Anyway, isn't it necessary to prove the crime before you start punishing for the crime? Seems to me that 1st degree murderers get treated better by our government than those who trade a 99 cent song. I don't know anything about megaupload, but it looks as if they could sue the bejeesus out of our govt. if they have the cajones. Probably don't have the money however since our govt is funded by all the American sheeple who will take this sitting down, no doubt...

Which they would need to prove beyond a doubt that it is ALL pirated material. Oh and they would still be liable under civil law for about 1-100000000000000...(way more zeros) lawsuits and class actions (which they would likely lose). Last thing our "broke" government needs is several class actions taken against the executive arm.
