As much as many of you people are so sure Apple is in the wrong here they actually have a valid case against Samsung. And while taking a casual glance at it, it may seem a bit frivolous. I mean a box with silver lettering? Which has a lid that when removed displays the product prominently? A rectangular tablet with rounded corners?With an even black border surrounding the display area? etc, etc.

Yeah, how is Apple the inventor of the rectangle? Well they're not, and they don't claim that either.

What is being claimed is Samsungs device from the packaging to the device itself can be easily confused with the iPad. If a company feels their work is being infringed on and such infringement could lead to lost revenue as a result of customers being deceived in believing they are buying something else they have a responsibility to their customers and stockholders to make things right! Apple is not the only company that protects it's products or image like this. Back in 2004 Microsoft sued Lindows, because the Linux distribution tried to make itself seem too much like Windows. 

Still don't understand, take a look at an 80's classic, Coming to America. Remember the restaurant McDowell's? McDonalds would have had them in court quicker than that Big Mick could pass through you!

Fact is the courts are full of cases like this. The end result is usually both both companies move cash around (Hell Microsoft won their case and still had to pay Linspire something like $20mi) and both CEOs laugh all the way to the bank.

So to sum it up, ask yourself; Would Joe Average Best Buy shopper be confused and buy Samsung's tablet, believing it's an iPad? As I said previously it doesn't help that the Best Buy sales people claim it's just like an iPad.

Why pay 300-400$ premium for less functional (no sd card slot, locked OS, no widgets, etc) when you don't have to. Even the 'average joe' knows an apple logo when he sees one. I agree with Holly Golightly when she said " Apple is in a lawsuit spree claiming they invented the entire industry with bland claims like this one."  I don't care for the way Apple does business either and I could care less for their products but in line with the above quoted statement maybe Apple should hire Al Gore to replace Steve Jobs since he "invented" the internet.

Corporations spending billions on brand identity and don't particularly like it when a competitor packs a similar product that can easily be confused with their brand.

This will be my first HTC phone. Apple has managed to make a permanent enemy of me. I will never buy another Apple product. Even as a gift for someone else.

What this ruling means to me is that it makes me want to go out and get an HTC phone.

And why would the president veto the ban when he's been known to play buddy buddy with Steve Jobs in the past? The president is looking to fill his re-election coffers, now would be a good time for Apple to make ahem.... a contribution?

whoever issued this should be fired from the patent office. the patent in question referring to phones linking text numbers to a dialer - isn't that part of all smart phones and coming way before the Iphone? what a load of bullshit.

It is something from way before the iPhone. I was able to do it on an old Motorola phone I had before Apple even put out their shit. Hell it was even on Blackberries. But you know how Crapple works. They want Android gone. They want to be the only smart phone out there. They know that they are in deep shit because of Android.

 

Notice how Apple has yet to go after blackberry and RIM? because it was no competition to them. RIM was eventually going to die out. But they will go after anything related to Android because Android is destroying Apple With quality products at a good price. Androids price to performance ratio is incredible. They give you options and have great customer service. Apple, has got none of that. They have one device in each area, 2 colors, and the shittiest business practices ever.

 

Apple needs to die allready. They will once Samsung drops them.

I agree with you. I'm an Iphone hater and I like android for what it's worth. While android is great, it's nothing special. Did you know when you enter a search in google they capture over 50 metrics? Everything from IP address to computer specs. What do you think they're using all that data for, you, me or maybe to further their own agenda and profits? Hopefully it doesn't take us 10-20 years to figure out all the behind-the-scenes hand-shakes and goals, maybe I'm just paranoid.

There software is fine. Compared to Apples garbage, its a god send. Apple is updating their broken software every couple of weeks because with each new update, they somehow manage to have another security flaw. Or something critical breaks, like the ability to make phone calls. Yeah, I have seen every part of an iPhone break at some update or another. As far as being "worm infested" That shit doesnt happen. Well not to someone that isnt a moron like you. Download apps from the market and you are fine. If you get apps off of the computer, make sure you go to a reputable source, like XDA and not wehackyou.fagnet.

As far as the so called "cheap plastic", I'll take plastic over that metal anyday. Why do you think you see half of the people in your town walking around with an iPhone that has a cracked screen? Because the phone is mostly metal. Its heavy, so when you drop it from even a foot off the ground, it breaks and gets all dented up. BUT, I can take a Samsung Captivate and throw it off of a 2 story balcony on to concrete and the only  thing that gets dmaged is the housing gets scratched up.

Slider or not, big screen or small, etc. They all have this thing called widgets, they are old news but haven't made it to the iOS yet. So yea, I don't have to go in Settings>Wifi>Turn on wifi. I can just tap a wifi widget.

I would take my older Nexus One any day over the 'latest' version of iPhone that have minor functionality increment improvements like able to 'copy/paste' or 'make a phone call without losing the signal'.

The problem with these bans are they are supposed to protect the small company from losing an income stream before the court date arrives.  It is to protect the small business person from being run out of business before they have their day in court. 

Apple and most of these large companies are not "losing" anything if the ban is denied.  So there is really no reason for it, except that they can do it without repercussions against themselves.

I suggest the laws should be adjusted.  Allow all the bans they want, if I recall they have blocked the Samsung Galaxy Tab 10.1 from Australia for about a year or more, and now HTC in the U.S.  I think if Apple bans Samsung in Australia and subsequently loses the court case, then Apple MUST remove any of their iPads (or whatever product was used as an example for the ban) for the same amount of time, from the same market  This solution would provide a risk for the company filing all these bans, lawyers would stop and think twice about attempting them unnecessarily, because if you were the attorney that filed the ban in australia or wherever, and lost, most likely you would be out of a job.  If there is repercussions back to Apple for these actions, there would be more competition and more time for the courts to deal with real cases.

True, they wouldn't be harmed, so they should be unable to file any motions to ban unless they can show they are making a product that is similar to the one being banned. Otherwise motion denied instantly, and the judge would never need to look at the motion.

Agree. They are also desperate. They were charging iDrones for services like backing up their contacts and other information. Android does that for free. They see the writing on the wall and have started being more reasonable but it is too little too late. They are trying to hamper Android by hook or crook(ed lawmakers).

First off they are similarities. Not the same thing, so no wrong has been done. Second, they are sueing over ideas that they never came up with. They just marketted it a bit better and it sold. When their contract is up with Samsung, they will be at the mercy of all the companies they have fucked over. And I am more than sure that mercy will not be shown. Android will rule the mobile world in the near future. Apple will burn, and i will be sure to go piss on there headquarters building and every apple store I come accross. Fuck you apple, fuck you Steve Jobs, (you dead bastard) and fuck anybody that thinks apple is right for practicing business the way that they do.

Biceps, is the only one that gets this! It's business pure and simple, and there isn't a top company that doesn't play ball like this. Just look at how many companies Microsoft has went after; and in turn go after them. It's all just a big game that pushes money back and forth.

Ultimately this is what is going to happen, HTC is going to pay Apple an large sum of cash, and then Apple is going to turn around and license those patents from HTC. All the while we are stuck in the middle paying for those deals, though higher margins on both sides.

Not necessarily, as HTC may license WebOS now, as it is open source. With Google having purchased a hardware company, and HTC not having any other avenue open to them in the way of revenues other than smartphones, WebOS makes more sense than sticking with Android long term

I have owned many Apple devices from the original iPods to iPhones and everything inbetween. The concept is ok. But they are not on par with what Android has become. I have developed software for Apple products and I don't personally like it compared to the capabilities of the opensource Android devices as well as the pure power and ability to customize every aspect.

 

I did not say that Android was going to be the only smartphone out there. I said that Apple will fall because of their shitty business practices and their lack of giving a fuck for anything other than their company. Steve Jobs was more than willing to bring Apple into the ground and ultimately end the company so that he could destroy Andorid. even without that bastard, they are still trying everything that they can to destroy Android. It will not happen. Apple is one company with contracts to Samsung for components that are in their devices, screens, memory chips, motherboards, pretty much the most important parts of their devices. Android on the other hand is Samsung, LG, HTC, MIUI, Motorola, Android as a company, Google as the owner and a few other companies. They have a revenue that far surpasses that of Apple and always will because they have devices with every carrier out there to include pay as you go companies. They also have a great business practice and a phone that can fit anybodies needs or wants. Also, they are open source. Developers, to include myself will go for that because it is easier to make stuff that is 10 times better and not censored.

 

Needless to say, Apple is going to crumble. You know it. Don't try to say its the way every business does things. It's not and that is a fact. Apple is just stupid. They are a cult full of hipsters and idiots that think it is ok to spend top dollar on sub par hardware and software. They can have thier shitty equipment. Its funny that I can build a windows based machine, hell I'll even say Linux, for $600 that is more powerfull han a $1800 dollar system Apple puts out. Face the facts. Apple's little empire of idiots will not last much longer if they keep going down the road they are on. They need to turn there little clown car around and go back.

Uh, I think you have the Open Handset Alliance confused with Android. FYI Android is an operation system developed by that alliance that is based on GNU/Linux which if Microsoft is correct is in violation of several of the patents held by them. Perhaps you may have heard about them making companies that use Gnu/Linux sign agreements. However that's no guarantee that they won't later sue for the said violations. After all they said they would never sue for people using the FAT system, but just a couple of years ago they sued Tom-Tom for using FAT.

Anyway if you think businesses don't do business like this, as well as articles like this being nothing, but sensalistic journalism.  So people like you get your panties in a wad. Why do you think this is the only place that makes a big deal about it? Then you got your head shoved up far somewhere, and that is a fact.

As far as the $600 machine, good luck with that. Sure Macs may look weak on paper, but add in OSX and it beats any Windows machine with the same specs. As far as Linux, hope you don't like watching movies. (yes, I know you can, but not legally.)

Expensive or not, Apple will stay in business because they make products that people like because they just work. People tend to upgrade to new Apple hardware because they loved the Apple hardware they previously had. In contrast why people upgrade from their previous Android devices, or even Windows where they tend to hate it so much they believe the next version will be better.

Wow. Yeah, Windows cannot sue Google because of the open handset alliance. Cellular phones are supposed to be open and free to use within certain limitations. Like actually paying for service. Other than that, you are allowed to do whatever you like with it.

 

Google doesn't go around sueing everybody out there because of stupid shit. Apple does, and Microsoft hasn't done anything crazy in a few years. Apple and Sony are the only 2 companies with their panties all wadded up.

On to your next topic... Apple computers are garbage. OSX is garbage. A windows based computer Is much better. Why?

Less than a third of the price for equal if not beter performance.

Upgradeability. You can upgrade any and all hardware without breaking any warranties

Games. Can be played without the use of a 3rd party program.

Programs that are free or less costly, that offer equal or better performance when it comes to audio creation/editing, image edditing/rendering, video and 3D moddeling and rendering.

 

Linux? I can watch movies legally on Linux. In fact i do. I have Linux on my laptop that I carry with me when I am out of town for work. I watch dvd's and blu-ray movies on it all legal. I have no idea where you are trying to go with that silly little comment.

 

Now, how is Crapple going to stay in business when the contract with Samsung is up?  Where are they going to go for high quality parts that are a huge part of "their" devices? After sueing Samsung multiple times over their stupid patent bullshit, Samsung is going to drop them. They will be much better off doing it. Apple is sueing them to pretty much make up for the cost of buying components from Samsung. Samsung knows this and will drop them.

People tend to upgrade their Apple products because they are morons. Its not actually Apples hardware anyways. It all comes from a few select different companies, that I am sure will drop apple as well for fear of legal action against them. Apple does not own a god damn thing they provide to the consumer. Not even OSX which is compiled and made of Linux.

I have owned many Windows based PC's. I loved every last one of them. But I also know how to use them. Viruses, no problem. Hardware problem, Fixed in a few hours.

I have also owned about 5 Android based phones. I have had absolutely no issues with them at all. I have owned 7 iPhones, and 2 iPod touches. why so many iPhones? Because they were weak. Screens on them sucked. Software sucked. They were boring. And broke non-stop.

 

Stop letting Apple be your slave driver. You are a part of the problem. A moron that sees things one way and can't open your eyes to what will happen. Android is a revolution. It is power, innovation, strong and open to the world. It will destroy Apple's mobile department.

Well I'm just going to put my thoughts on a few of your sentences.  First:  OS X is brilliant, used on a PC instead of a locked down POS MAC.  It's more stable than windows at any given time because the kexts(drivers, for you non OSX people) are designed to specifically work with the hardware.  Right now, I'm running a z68x-ud3h-b3 mobo, with an i5-2500k OC'd to 4ghz, and 8gb of corsair RAM with a 8400GS(had to edit some kexts to get this working).  Right now, It's more stable than my win7 partition.  OS X is superior in some ways than windows, like music management and a few other things(iTunes is not actually a POS in OS X).

Second, OS X has a Unix based kernal rather than "compiled on linux".

Third:  Their OS is only $30.  How much is win7 ultimate?  Something like $189 on newegg, and has multiple versions.  OS X is 64 bit compatable, can do everything win7 can do to some point or another, and is $150 cheaper.  If you have the balls, I suggest you take any intel based PC and try installing snow leopard on it(I am running lion).  I can highly suggest it to any person who doesn't like windows and would like a hackintosh for less than $600(using old/leftover HD parts, peripherals etc).  IMO, the only thing that OS X lacks is gaming, which I shall concede to windows indefinitely.

Idk what you are smoking but I want some.  Selling the OS for $30 to kinda make you feel ok for the rod the raped you with on the cost of everything else doesn't make htem better.  Just a base model Mac Pro would cost $2500 that is for a Nehalem Intel processor which is a generation or two old, 3GB of memory and no monitor included the monitor to add on is $1000 when I can get the same sized monitor for a PC for less than a third of that.  I could build a kick ass PC with a 32" TV as a monitor and still come in under what I would pay cor an Apple computer who in their right mind would do that?  Apple needs a reality check and when certain contracts are up it will happen.  Here is a run down of system and cost comparison.

Newer hardware Cheaper price and would run way better.  Give or take a couple hundred for the OS but I have a copy already and will just put it on that so oh well PC cost and performace is still a win.  Apples are over priced and running on old hardware.  The ones that are on current hardware are double the price.  

 

Before you try to say I don't know what I am talking about I have a MacPro and a similar build to what I posted the Mac is only used so I know how to help people when they have issues so I do know the ins and outs of it and use it frequently.

You're a Max PC reader, so I'll assume you know the differences between TN and IPS LCD panels. It has been covered in depth in the magazine. That said, pretty much all 27" IPS monitors are in the $899-$1,100 range. Apple, LG, Samsung, Dell, NEC... all of them. To Apple's credit, the Thunderbolt Display at least includes a Thunderbolt hub and maintains the same $999 price as their Cinema Display.

To compare an IPS display and consider it an equal to any random television you could buy at your local Wal Mart really risks your credibility.

Since you say that you own a Mac Pro and "know what your talking about", you'll undoubtedly know that a Mac Pro is an enterprise machine and not a product directed at the consumer market. This is why it uses a ridiculously expensive Xeon processor instead of a more common, and cheaper, i7. Comparing a pre-built enterprise machine against a DIY consumer machine is impossible. Lenovo and HP enterprise machines start at $1,600 and only go up from there as better hardware is added. If you have an issue with the cost of Xeon processors (the 2.8 GHz Nehlam the Mac Pro uses retails for a little over $1,200 at Newegg right now), you'll have to take that up with Intel, not Apple. Enterprise-grade hardware is expensive regardless of the manufacturer.

If you had done your research the SandyBridge i7 Processors are proven better that the Nehalem Xeon's in any tests.  Also the TV I picked was not some generic POS you can pick up at any Walmart.  

As far as the MacPro being an enterprise class machine I know this.  I can also build a similar enterprise machine to what I built here by shuffling a few things around and still come in under it.  Or doing two separate builds with consumer grade parts and models and the outcome will still be the same.  Like I said previously I do this for a living and I am good at what I do.  I don't through a PC together willy nilly I do my research on components and get them all settled out as best I can before any purchases are made.  

As far as the whole monitor issue goes the Thunderbolt stuff is nice and all but until other hardware catches up there is a huge bottle neck and not really any gain.  You can have a 6 lane highway for one car doesn't make the car faster or better just has more room to play around with.  

Thunderbolt displays are IPS as was the LG TV I picked.

I have done the Hackintosh with my i7 2600k OC'd to 4.5ghz with an ASUS P8P67 PRO, 8 gigs of G-Skill RAM, and an ASUS GTX 460. It was unstable for me and for some reason wouldnt boot half the time even when I had my clocks at stock. The one thing that I hate the most about  OSX is that when it does blue screen, and it does, there are no error codes. Also half the time it does blue screen it is unrecoverable, even on their own hardware. Some people are lucky others aren't.

 

Apple can aford to sell their OS at that price because they rob people when it comes to hardware. $1500 for a laptop with mid range hardware? Seriously?! That is insane. Apple does not deserve a single penny from me even if their OS is dirt cheap.

 

They are a corporate monster. As bad as Hitler. They care not for the consumer, they care not for their partners and contracts. They care only for themselves and will do whatever it takes to be the only provider of computer and mobile stuff. But the one thing everyone fails to notice, is that the companies that make the components that go into their devices, have been screwed by Apple's lawsuits and bullshit. They are going to drop Apple as soon as the contracts are over. Apple will not have a leg to stand on when it does happen.

So this makes it on your site, but when HTC files a lawsuit against Apple (Sep 11) for infringing on patents they purchased from Google, no mention of it.

I'm not for frivolous law suits, but honestly, I wish every electronics manufacturer would get together and sue apple for every patent that could even remotely be linked to infringement. Don't settle for some agreement, just have every product apple makes banned.

This seems to be the way apple does business. Throw a bucket of patent suits at your competitor and hope one sticks. Why compete when you can just get the government to eliminate them? Its time they get a taste of their own medicine.

I pray that Google finishes their aquisition of motorola and turns the tables on those bastards in cupertino, for the good of everyone.

It is seriously time for Android and their associated hardware manufacturers to crush this rotten fruit once and for all!!! apple is a total coward; all bullies are.... with their leader dead, they are grasping at straws now... frankly, one doesn’t make enemies or kill off generals if you wanna conquer the world.

i am sincerely looking forward to the time when their contact with Samsung expires.... they will then have to scavenge thru scrap for their iShitZ....!!!

Their time will come... and soon too.!!!
