Android Trademark Suit Tossed Out of Court
Erich Specht, a man who ran a data company called Android Data from 1998 through 2002, won't be receiving the $94 million payday he was hoping for. That's the amount he wanted Google to pay him for allegedly infringing on his trademark with the "Android" brand, but a judge didn't see it that way, TechCrunch reports.
Google filed a Motion for Summary Judgment to dismiss the case, and not only did the judge do that, but he also canceled Spect's original trademark, both because he's already used it "as a sword" against Google, and because it could cause confusion with Google's Android trademark.
"We are pleased to see this case dismissed, as it was baseless from the start," Google said in a statement.

Wouldnt someone with a company named "Android Data" be at risk of being sued by whoever owns the rights to Data on Star Trek?

i think George Lucas or one of his companies own it. i remember seeing one of those little disclaimer things at the bottom of a web page around the launch of android stating "Android"TM is property of Lucasfilm or something like that.

Nice to see these BS law suites get thrown out of court. Hope they make his gold digging ass pay both sides legal bills.

It's no wonder the moron lost his suit. He abandoned his mark in 2002. He has no claim against google, and google was right in moving for the counterclaim. The judge ruled properly. If the guy would have preserved his mark, maybe he would have had something, but tough luck.

Now what about all the crap Apple is putting everyone through. Sueing people over the use of "pod" in their names even it if has nothing to do with any apple products. How can a company patent and trademark a common word. I think there needs to be regulations on this. I understand the need to protect your intellectual property but people just take it too far. Sometimes I wish I could just kick Steve Jobs in the nuts because he needs a good swift kick for being a jerk.
